WHAT IS MEDIATION?


Mediation is an opportunity for disputants to resolve conflict through the assistance of a neutral third-party.  The mediator provides a constructive framework so the parties may identify issues, create options, generate proposals and reach agreement.  The parties can tailor their agreement as best fits their needs, resulting in more comprehensive, creative, and personalized solutions than what would be handed down by a judge.  Unlike court rulings, terms cannot be forced on parties; only terms fully accepted by all parties are included in a mediated agreement.


Mediation is not a legal procedure and, in general, is less stressful and formal.  


Ideally, mediation is a face-to-face discussion between the parties; however, in some cases relations between the parties do not allow for this. For these situations a mediator employs "shuttle mediation" where the mediator acts as a go-between with the parties in separate rooms. Mediation can also be done via phone when distance is a factor.


Representation is not required for mediation, although disputants

are allowed to have attorneys with them if desired. 


Mediation is confidential.  What is said in mediation may not be

used in court or discussed with non-parties.
